Credit Card Surcharge & Compliance

Visa conducts regular compliance reviews.
If any of the following violations are identified, the restaurant may face significant fines or account risk:

  • Non-compliant credit card surcharges
  • Improper minimum purchase amount settings
  • Incorrect cash discount or pricing display practices

Key Compliance Guidelines

Minimum Purchase Amount

  • Debit Cards: Minimum purchase amounts are NOT allowed
  • Credit Cards: Minimum purchase amount may not exceed $10

Cash Discount

  • Menus and pricing must display the credit card price
  • Customers may receive a discount when paying with cash
  • โŒ Displaying a cash price and adding an extra charge for credit cards
    is considered a surcharge and is not allowed

Credit Card Surcharge

  • Surcharges do not apply to debit cards
  • May be charged as a flat amount or a percentage
  • Maximum surcharge may not exceed 3% of the transaction amount
  • Clear signage must be posted at the restaurant entrance and point of sale

States Where Credit Card Surcharges Are Prohibited

  • Massachusetts (MA)
  • Connecticut (CT)
  • Maine (ME)
  • Oklahoma (OK)

Other Fees

  • Convenience Fee
    • Only permitted for payments made through third-party platforms
      (such as BeyondMenu Online, Uber Eats, DoorDash)
  • Service Fee
    • Only allowed for government agencies, hospitals, schools, and other public institutions
